Democrats Sue Their Own Incompetence

Back in February I wrote about the irony surrounding the Democrats accusation that McCain had violated campaign finance laws. At the time I noted that Senator John McCain has recently been caught up in the campaign finance laws he helped to author, while the Democrats are asking for an investigation from a commission they have yet to appoint members to.

John McCain had notified the Federal Elections Commission of his intent to withdraw from public financing and was told it would require approval from the commission. Approval would be granted if four of the six member commission granted it, however the commission currently only has 2 members. Democrats have refused to confirm additional members to the committee because one of Bush’s nominees Hans von Spakovsky supports voter ID laws.

This has led to complaints from Democrats over appointing a “partisan” commission member, however in their ignorance they ignore a very simple fact. All commission members are partisan, and the commission is setup in such a way as to guarantee that. Of the 6 members, three are supposed to be Republicans, and three are to be Democrats, which is why the approval of four members is necessary for McCain to withdraw from public financing. In fact, Hans von Spakovsky could not be confirmed unless a Democratic appointment was confirmed at the same time.

The DNC has now decided to take the matter to the courts, effectively suing their own incompetence to appoint members to the commission.

A lawsuit against the Federal Election Commission, to be filed Monday in U.S. District Court, questions the agency’s ability to enforce the law and review McCain’s decision to opt out of the system.

Are they really questioning the agency’s ability to enforce the law? McCain had requested to opt out of public financing over 2 months ago, and Democrats refuse to appoint members to the commission which is responsible for accepting that request. They then turn around and sue that commission for lacking the ability to review McCain’s request. This is why lawyers are the punch lines of so many jokes; they make it so darn easy to make fun of their lack of common sense.
