Governor Spitzer Suing Bush Administration
I am not sure if I should laugh or cry after reading a blog entry by NY State Governor Elliot Spitzer at the Huffington Post. It makes me laugh because it shows how little many Democrats know about the Government they are supposed to be running, but at the same it me it makes me cry because it reminds me of the type of culture we are now living in. Every day we read about new lawsuits being filed for one reason or another, wether it be the woman suing Apple because they reduced the price of the I-Phone sooner than she anticipated, or the idiot judge who sued his dry cleaner for $54 million because they lost his pants. Our country is no longer the country given to us by our grandparents which stressed hard work, we are now a country of entitlements. People feel they are entitled to be happy, entitled to be employed, entitled to be well liked by their peers, and entitled to have everything their neighbor has. The fact remains no person is entitled to the above, although every person is given the opportunity for the above.
Once again I find myself thinking out loud so to speak, and have gotten off of the subject a little, this article was meant to focusing on the whining of a Democrat, not out of control lawsuits, although in this case they happen to be one in the same. Elliot Spitzer’s blog entry at The Huffington Post is titled “Why I’m Suing the Bush Administration, and here is what he says:
After months of negotiation and countless attempts at compromise, the Bush administration is still refusing to let New York and other states across the country expand their State Children’s Health Insurance Programs (SCHIP). The president is refusing to back down from destructive new rules his Administration has imposed — the sole purpose of which are to curb bi-partisan state efforts to insure more of our nation’s children.
It didn’t have to come to this. There is widespread bipartisan support for expanding SCHIP. Even many members of the president’s own party have recognized how out-of-touch he is with the American people, and instead have chosen to support compromise legislation in Congress repealing these arbitrary rules.
Unfortunately, President Bush has repeatedly threatened to veto this bipartisan bill. In justifying his position, his administration has tapped into the politics of fear — branding the effort as “socialism.”
It is imperative that we all come together to reverse the Bush administration’s attempt to override the will of Congress, the will of the states, and the needs of our children.
I find that last sentence to be one of the most ignorant statements I have heard from a State Governor. Perhaps Governor Spitzer should read the united States Constitution so he may better have an understanding of how our government works. In lieu of that, allow me to give you a quick lesson Governor.
When a bill passes Congress it is then presented to the President for his (or her) signature. If the President disagrees with the bill, he has the power to veto it and send it back to Congress. At that point Congress can override the Presidents veto with a 3/4 vote in favor.
If the President chooses to veto the expansion of the SCHIP program it is well within his rights, much like it is within the rights on Congress to override that veto and pass the bill without the Presidents authorization. One thing that cannot happen however, is for a court to order President Bush to sign this bill. No court in the land, not even the Supreme Court, has the authority to force the President to sign a bill. It’s called ’separation of powers’, maybe you have heard of it.
If Governor Spitzer, along with he other Governors involved in the lawsuit, wish to expand Health Insurance to children in their own States it is completely within their right to do so. President Bush did not tell Governor Spitzer that he was not allowed to expand coverage in NY State, what Governor Spitzer was told was that he would not receive additional Federal funding in order to do so.
