ACLU Claims Abstinence Education is Unconstitutional
The ACLU recently sent a letter to North Carolina school districts claiming that abstinence-only education violates the state constitution. The letter dated Feb. 2, stated that abstinence-only programs “undermine the equal opportunities for all public school students that are required by state law.”
I am not quite sure what “equal opportunities” the ACLU is referring to, however I would like to look at their “fact” sheet which was attached to the letter. The ACLU objects to the pamphlet “Everyone is not doing it” in part because rather than using the scientifically proven rate (i.e. laboratory tests) of failure in condoms, the pamphlet uses the “typical use” failure rate.
Unless the ACLU intends to employ a team of scientists to travel the country and assist young men in putting on condoms everytime they intend to have sex, I do not believe the “scientific rate” of failure applies. The pamhplet uses the “typical use” failure rate because the studies which showed the 16% to 18% failure rate were conducted in the real world, not a laboratory.
The Center for Disease Control has a fact sheet on condoms and STD’s which says:
The surest way to avoid transmission of sexually transmitted diseases is to
abstain from sexual intercourse, or to be in a long-term mutually monogamous
relationship with a partner who has been tested and you know is uninfected.
I am still scartching my head wondering how the ACLU considers abstinence only education unconstitutional. One thing is for sure however, I would not want them in charge of my daughters education!

Do you ever get funding letters from the ACLU in the mail? This group is so offensive even I can’t come up with a smart*ss remark.
The ACLU letter never claims that abstinence-only education is unconstitutional–just certain statements within the curricula.
If you’re going to attack someone’s work, at least get it right.
